By accessing or using FindHVACOKC.com ("Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our Platform.

FindHVACOKC.com is a lead generation and referral platform that connects homeowners and businesses with independent HVAC contractors in the Oklahoma City metropolitan area. We are not an HVAC contractor and do not provide HVAC services directly.

Our services are limited to the Oklahoma City metropolitan area, including Oklahoma City, Edmond, Moore, Norman, Midwest City, Del City, Bethany, Warr Acres, Yukon, Mustang, and surrounding communities within a 50-mile radius of downtown Oklahoma City.

• We do not employ, control, or direct the HVAC contractors
• We are not responsible for the quality, timing, or outcome of contractor services
• All service agreements are directly between you and the individual contractor
• We do not guarantee contractor availability or response times

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Platform.

• Provide accurate, current, and complete information
• Use the Platform only for legitimate HVAC service needs
• Not submit false or fraudulent service requests
• Respond promptly to contractor communications if you submit a request
• Treat contractors and Platform staff with respect
• Comply with all applicable laws and regulations

• Harvesting contractor information for competing services
• Submitting spam or automated requests
• Attempting to circumvent Platform security measures
• Using the Platform for any unlawful purpose
• Harassing contractors or other users
• Posting false reviews or making defamatory statements

1. You submit a service request describing your HVAC needs
2. We match you with up to three qualified contractors in your area
3. We share your contact information and service details with these contractors
4. Contractors may contact you by email with quotes and availability
5. Any phone or text communication requires your separate consent directly with the contractor

• All initial contractor communications will be via email
• Emails will clearly identify the contractor and include unsubscribe options
• You are under no obligation to respond or accept phone/text communications
• Quality contractors will respect your communication preferences

We require contractors to provide:

• Current Oklahoma HVAC contractor license
• General liability insurance (minimum $50,000)
• Workers' compensation insurance (if applicable)
• Proof of EPA Section 608 certification
• Business references

• Verification is performed at registration and annually thereafter
• We cannot guarantee continuous compliance with all requirements
• License and insurance status may change without our knowledge
• Past performance does not guarantee future results
• You should independently verify contractor credentials

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES OR REPRESENTATIONS REGARDING:

• Quality of contractor workmanship
• Timeliness of service delivery
• Accuracy of contractor estimates
• Resolution of disputes with contractors
• Compliance with building codes or permits
• Contractor business practices or ethics

Our Platform is free for consumers seeking HVAC services. We do not charge fees for submitting service requests or receiving contractor referrals.

We receive compensation from contractors for qualified referrals. This compensation does not affect which contractors we recommend or the prices you pay for services.

Our financial relationships with contractors do not influence our matching process beyond basic eligibility requirements.

All content on FindHVACOKC.com, including text, graphics, logos, and software, is our property or licensed to us and protected by intellectual property laws.

By submitting information through our Platform, you grant us a non-exclusive, royalty-free license to use that information for providing our services.

You may not:

• Copy, modify, or distribute Platform content without permission
• Use our trademarks or logos without authorization
• Reverse engineer or attempt to extract our source code
• Create derivative works based on our Platform

Your use of our Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Platform, you consent to our data practices as described in the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED $100.

THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US.

You agree to indemnify, defend, and hold harmless FindHVACOKC.com, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Any dispute between you and an HVAC contractor

These Terms are governed by the laws of the State of Oklahoma without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Oklahoma County, Oklahoma, under the rules of the American Arbitration Association.

You waive any right to bring claims on a class, consolidated, or representative basis.

Either party may bring qualifying claims in small claims court.

By using our Platform, you consent to receive electronic communications from us. These may include service updates, policy changes, and contractor-related communications.

If you opt-in to SMS communications, message and data rates may apply. Text STOP to cancel at any time.

We reserve the right to modify, suspend, or discontinue any aspect of our Platform at any time without notice.

We may update these Terms periodically. Continued use after changes constitutes acceptance of the modified Terms.

You may stop using our Platform at any time. Contact us to delete your account and personal information.

We may terminate or suspend your access for violations of these Terms or for any other reason at our discretion.

Upon termination, your right to use the Platform ceases immediately. Provisions that should survive termination will remain in effect.

These Terms and our Privacy Policy constitute the entire agreement between you and FindHVACOKC.com.

If any provision is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce any right or provision is not a waiver of that right or provision.

You may not assign your rights under these Terms. We may assign our rights to any successor.
